Office Branch

A company incorporated registered under foreign laws may establish a Branch Office to operate its business activities in Thailand. Thai Branch offices are treated as the same legal entity as a subsidiary company. Therefore, the branch offices are required to maintain only those accounts relating to the activities of the branch in Thailand; however, the Revenue Department considers any income subject to Thai tax, as earned by the foreign head office.

To conduct Thai Branch Offices, the foreign company must file certain application forms to the Ministry of Commerce in order to begin business activity in Thailand. The branch office may exist for an indefinite period up to its date of dissolution. The minimum capital amounting to three (3) millions baht must be brought in to Thailand as a condition for approval of a foreign business License as a branch of a foreign corporation. However, this amount can be changed by subsequent Ministerial Regulations.
